Document provides examples of how liability insurance is shared between freight rail, passenger rail and Amtrak. Each state has laws that dictate the liability and indemnity (security against loss) that is allowable for contracts for locations that share rail Right of Way. This report highlights the insurance burden (or lack) of freight rail. More states are intervening in the contract negotiation process to share rail right of way. Many of the anticipated liability and indemnity contracts include strategies for insurance investments.
